Terms of service
1. Scope and contracting party
These terms and conditions apply to orders for goods placed with Guido Pelikan, trading as Pelikan’s Hockey, Finkenweg 7, 84152 Mengkofen, Germany, email: info@pelikans-hockey.de, telephone: +49 8733 9378324.
A consumer is a natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business customer is a natural or legal person, or a partnership with legal capacity, acting in the exercise of their trade, business or profession when concluding the transaction.
Special B2B terms apply to customers registered or approved by us as a business and ordering for that business. Entering a company name alone does not establish entitlement to B2B terms. Mandatory consumer rights depend on the actual purpose of the transaction and remain unaffected.
2. Formation of the contract
Products displayed in the online shop constitute an invitation to place an order. By selecting the button to place an order with an obligation to pay, you submit a binding offer to purchase the goods listed during checkout. The purchase contract is concluded when we accept your order by an order confirmation sent by email. Individual quotations, particularly for international shipping, are subject to the terms expressly stated in them.
3. Prices, shipping and payment
Prices displayed to consumers include statutory VAT. B2B prices expressly identified as net prices exclude VAT, which is added where legally due. Tax exemptions apply only if their legal requirements are met and the necessary evidence has been provided.
Additional packing and shipping charges are governed by our shipping policy and are stated before the order is placed. For deliveries outside the EU, an individual shipping quotation must be obtained and agreed before placing a binding order. Any import duties or charges in the destination country must be considered separately in the quotation.
Available payment methods are displayed during checkout. Where advance payment is agreed, we ship after receipt of payment. Different payment terms require express agreement.
4. Delivery and retention of title
Delivery areas and shipping terms are set out in our shipping information. The delivery time communicated before ordering or agreed in an individual quotation applies. Goods remain our property until payment has been received in full.
5. Withdrawal, returns and defects
Consumers have the statutory right of withdrawal as set out in our withdrawal policy. The statutory exceptions explained there remain applicable. Statutory rights concerning defective goods are not restricted by any return or withdrawal provision.
Business customers do not have a statutory consumer right of withdrawal. Voluntary cancellation, return or exchange of goods without defects requires an appropriate agreement; any cancellation or return rights expressly granted remain in effect. Statutory rights relating to defects, non-performance or other breaches of duty remain unaffected.
6. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
